Mediation and Workers’ Compensation Claims

Mediation is an avenue to resolve disputes in workers’ compensation claims without the need for a hearing. This process provides the parties a way to resolve a dispute so that a resolution is reached between you and the insurance company with the help of a third party mediator.

At mediation, each side will sit down with the mediator in separate rooms (typically a judge or lawyer who has been trained in mediation) and present their position and any documentary evidence. The mediator will then act as an impartial go between with the parties to resolve the issue and reach a resolution that meets the needs of both sides.

While most mediations in workers’ compensation cases deal with settlement, mediation can also be used to resolve issues related to a change of physician, medical issues (i.e. payment of a medical bill in compensable claims), suitable employment issues, attorney fee disputes, and average weekly wage disputes among others in compensable claims.
